Obwohl der Gerichtsstand der Streitgenossenschaft manchen Rechtsordnungen schon seit mehr als zwei Jahrhunderten bekannt ist, stellt das Institut auch heute noch Rechtsprechung und Lehre vor große Herausforderungen. Die vorliegende Arbeit möchte einen Beitrag zum besseren Verständnis des Instituts sowie zur grundlegenden Frage leisten, ob es sich empfiehlt, einen solchen Gerichtsstand überhaupt in das Recht der internationalen Zuständigkeit aufzunehmen. Dazu wird in einem ersten Teil ein umfangreicher Rechtsvergleich zwischen dem englischen, französischen, österreichischen und dem europäischen Recht vorgenommen. Im zweiten Teil erfolgt eine umfassende Analyse der involvierten Zuständigkeitsinteressen.
