Inspiriert durch rechtsvergleichende Betrachtungen schlägt er vor, zwischen direkter und indirekter Unternehmenshaftung zu unterscheiden und erstere gegenüber letzterer zu stärken. Er entwickelt eine differenzierte Dogmatik der direkten Unternehmenshaftung, die er sodann für die Unternehmens-Gefährdungshaftung, die Unternehmens-Fahrlässigkeitshaftung und die Unternehmens-Vorsatzhaftung konkretisiert. |
