It also describes the problems for the democratic rule of law that result from the creation of the Commissioners. The main aim of this thesis is to find out whether the legal basis of the Commissioner should be reformed. Published Beauftragte finden sich sowohl in gesetzlich geprägten als auch zunehmend in gesetzesfreien Bereichen. In dieser Untersuchung werden die historische Entwicklung und die charakteristischen Merkmale der Bundesbeauftragten und der Beauftragten der Bundesregierung analysiert. Dabei stehen auch die Probleme, die mit dem Einsatz von Beauftragten für den demokratischen Rechtsstaat verbunden sind, im Fokus. Die meisten Beauftragten können durch ihre Informationstätigkeit lediglich faktisch das Geschehen im Staat beeinflussen. Es wird empfohlen, einerseits die Anzahl der Beauftragten zu begrenzen und andererseits besonders bedeutende Beauftragte mit mehr Befugnissen auszustatten. Eine solche Aufwertung macht eine gesetzliche Regelung der Tätigkeit der Beauftragten erforderlich. Eine verfassungsrechtliche Normierung ist nur bei Beauftragten mit herausragender Bedeutung anzustreben.
