In addition to a reform of the Film Subsidies Act and the introduction of a tax incentive model, an investment obligation for on-demand audiovisual media services is also being considered in terms of legal policy. Streaming services from international providers such as Netflix, Amazon Prime Video or Disney+, as well as video-on-demand services from German TV channels such as RTL+, joyn or WOW, could be obliged to invest in European works, but above all in works in German, in accordance with certain quota requirements. Such a state investment obligation raises fundamental questions of constitutional and European law, which the study examines. |
