Sumari:As uterus transplantation (UTx) is performed to enable a patient’s reproductive goals, it may be taken as axiomatic that the welfare of any children that might be created through UTx should be assessed as a condition of treatment provision - the pre-conception welfare principle (PCWP). However, the purpose and role of the PCWP in the regulation of access to UTx is questionable. Indeed, in the context of assisted reproduction generally, the PCWP already raises several concerns regarding the opportunity it creates for value judgement and discrimination against patients. In this chapter, I critically examine the role of welfare considerations in the context of UTx as both a threshold requirement of access to IVF and as a potential criterion to inform transplant listing and allocation policy. I explore and reject proposals in favour of utilising the PCWP to determine both patient listing for transplantation and organ allocation on the basis that it would lead to unjust discrimination against patients, and be unduly burdensome and contrary to established ethical and policy guidance on organ transplantation.
