Dafür muss eine bislang zu wenige beachtete Dimension in den Vordergrund gerückt werden: die verfassungsrechtliche. Sie bildet nicht nur den Grundstein für die Legitimation des deutschen Schiedsverfahrensrechts, das privatem Schiedsverfahren und Schiedsspruch verbindliche Wirkungen zuspricht, sondern erst recht für jede Erweiterung seiner Bestimmungen. Wie sich dies auf die Möglichkeiten, aber auch die Grenzen der Abbildung von Mehrpersonenverhältnissen im Schiedsverfahren auswirkt, ist Gegenstand dieser Arbeit. |
