Published Das Narrativ vom ›bellum legale‹, also des Ausschlusses »gerechter« Kriegsgründe aus dem kollektiven Sicherheitssystem, hat den ›bellum iustum‹-Begriff im Völkerrecht nicht unschädlich gemacht, noch könnte es das. Denn selbst wenn man glaubt, der Lesart einer positivistischen Adaption des ›bellum iustum‹-Begriffs rigoros eine Absage erteilen zu müssen, kommt man letztlich nicht umhin zuzugestehen, dass der Rekurs auf naturrechtliche Gedanken nicht ausgeschlossen werden kann, da Recht wertbezogen ist. Das Völkerrecht und seine Narrative können den ›bellum iustum‹-Begriff nicht »überwinden«. Sie können ihn allenfalls in ihrem Sinne prägen beziehungsweise zu prägen versuchen. Denn das Völkerrecht ist im Kern ein Recht des Krieges und des Friedens, ›de jure belli ac pacis‹. Das heißt, eine völkerrechtliche Kriegsrechtfertigung kann nicht wertfrei sein.
