Kilian Sendlmeier unterteilt schiedsrechtliche Bindungsansätze nach deutschem Recht systematisch in solche, die nach einem Schiedswillen fragen, und solche, die bereits von ihrem dogmatischen Ansatz auf einen Schiedswillen verzichten. Für Letztere werden erstmals einheitliche Voraussetzungen formuliert. Vor dem Hintergrund des Freiwilligkeitsgrundsatzes und der staatlichen Justizgewähr ist Schiedsbindung stets verfassungsrechtlich zu rechtfertigen. Daher erfolgt auch eine detaillierte verfassungsrechtliche Überprüfung unfreiwilliger Schiedsbindung. |
