Summary:The conception of the Peruvian State based on the Constitution of 1860 is analyzed taking into account the type of government, territory, elections, powers, established rights and functions. The legal methodology was used, using sources of law such as doctrine and legislation, to establish a coherent and systematic framework in the study. According to the Constitution of 1860, the Peruvian State was defined as the political association of all Peruvians, with a republican, representative, democratic and unitary government. Its goal was to protect the Catholic religion and guarantee free primary education. The Constitution also established national sovereignty and the separation of powers as fundamental elements. We believe that when analyzing this definition of the State, favorable and unfavorable aspects are identified, which indicates that it would not be appropriate for today. However, it is recognized that in its historical context it accurately reflected the sociopolitical principles and characteristics of the time.
