description The use of automated facial recognition in law enforcement is not some dystopian future, but is already in full swing worldwide. In Germany, the Federal Criminal Police Office, the Federal Police and state police authorities have been using facial recognition for around two decades to identify unknown suspects. The author examines this investigative measure from the perspective of constitutional law, EU law (including the AI Act), the ECHR and criminal procedure law, as well as taking into account criminological and empirical findings. She argues that there is no legal basis for this investigative measure and develops a regulatory proposal.
