Beskrivelse
Summary:This work is structured as follows: 1) Study of the content of the work “Form Libellandi” by Antonio Pérez Martín.In it APM highlights the editorial success of the work, since in a few years it reached 21 editions. In his study he takes into account the editions of Toledo of 1500 (which is reproduced here), that of Burgos of 1536, that of Salamanca 1551 and that of Salamanca of 1500 that differs from the others because he adds in the end seven pieces. He states that the work is a mixture of forms and "news" or doctrinal exhibitions. The forms, without a precise order, refer to all parts of the process, both civil and criminal, competition between secular and ecclesiastical jurisdiction, etc.It maintains that some more than mere forms, are documents presented in their day to the competent authorities. The doctrinal exhibitions, based on a study published in Seville in 1981-199 and in Murcia in 1999, concludes that it is not an original research work but materials taken from the usual literature of the time. The works cited are mainly works of the “Ius Commune”, both of Roman law (Digest, Code, novels and Baldo) and Canon Law (Decree of Graciano, Gregorio IX decretals, Sixth Book and Glossators). However, works of Castilian law are also cited: real jurisdiction, Alcalá system of 1348 and Briviesca order of 1387. 2) Biography of Dr. Infante, by Justo García Sánchez.Based on the Salamanca JGS documentation, it manages to base new data on the life of this Sevillian jurist: his name is Pedro Fernández Infante, a graduate and doctor of law from the University 12 3) Sources of the "way of liberating" for Justo García Sánchez. In it JGS maintains that we are facing a work that is not printed in the author's life and even that its author did not plan to publish, but are a set of materials available as the result of their teaching activity (preparation of academic degrees and aspirationto vacancies) and his professional practice as a lawyer and as a lawyer of the Salamancaus. The sources used are the Hispanic legal sources, as well as those of the "ius commune", both the canonies and the Roman and the doctrine of the glossators and the commentators. 4) Facsimile edition. The specimen preserved in the Library of the University of Navarra is reproduced, finished printing in Toledo on August 5, 1500 by the teacher Pedro Hagenbach.
