সংক্ষিপ্ত:In the Colombian context there are specialties that by jurisprudential means are cataloged in themselves, a priori as obligations of result, thus framing them in an objective regime of responsibility, this is how the SC7110 judgment of November 5, 2013 indicates that when In the case of plastic surgery with a healthy body, it is understood that the debtor has everything under his control and that is why the promised benefit will be fulfilled, despite the fact that there are cases in which this type of specialties can develop activities that are remote of the foundation of satisfactory medicine are part of the comprehensive treatment of a clinical condition, such is the case of the specialty in plastic surgery in the scenario of the patient with gender dysphoria. This research aims to determine the legal responsibility of the health professional in the management of gender dysphoria based on the criteria of civil liability and the applicable legal regime according to the theoretical perspective of Professor Javier Tamayo Jaramillo. Using a qualitative approach through the documentary analysis and case study proposed by Daniel Bertaux, he intends to study the sentences of the constitutional court in the period between 2012 - 2020 that deal with gender dysphoria, to validate the recognition of surgical procedures as part of the comprehensive management of this condition, coupled with the scientific foundation supported by the current clinical practice guidelines on the matter, to later carry out a study of the responsibility applicable to them.
