Die gesetzliche Organhaftung für Geschäftsführer:innen von GmbH und Vorstandsmitglieder von AG ist durch geänderte Rahmenbedingungen sehr streng geworden. Eine überstrenge („existenzbedrohende“) Haftung kann jedoch die Leitungsorganmitglieder zu einem risikoaversen Management anhalten.
