Doch genügte es, ein Viertel des Intestatteils zu hinterlassen, um das Testament im Umfang des ganzen Intestatteils vor einer Testamentsaufhebung zu sichern. Gegen Schenkungen, die gemacht waren, um einen leeren Nachlass zu hinterlassen, gaben kaiserliche Reskripte ebenso das Viertel.
