In doing so, Cara Warmuth includes methods and findings from statistics and psychology in her legal analysis. Her experimental study with 136 judges shows that appeal judges may tend to confirm the first-instance decision in an irrational way. To avoid this appeal-specific affirmation bias, the author proposes, among other things, a preliminary blind procedure at the courts of appeal. |
