Published Die Arbeit befasst sich mit dem zunehmenden Selbstverständnis der Verfassungsgerichte unter dem Deckmantel der Drittwirkung privatrechtliche Streitigkeiten an sich zu ziehen und als »Ersatzgesetzgeber das Privatrecht fortzubilden. Bei dieser Rechtsschöpfung entsteht – weitgehend unbemerkt – eine neue Ebene des Privatrechts: »Verfassungsprivatrecht«. Ausgangspunkt dieses ungeschriebenen Regelwerks ist die Bindungswirkung verfassungsgerichtlicher Entscheidungen. Verfassungsprivatrecht bindet neben der gesamten Zivilgerichtsbarkeit auch den Gesetzgeber. Einschlägige Rechtsprechungsbeispiele, etwa die Stadionverbotsentscheidung, werden meist nur mit Blick auf die Drittwirkungsmodelle untersucht. Die eigentliche Sprengkraft folgt jedoch aus den verbindlichen Vorgaben für die Zivilgerichtsbarkeit und den Gesetzgeber, die aus den Entscheidungen resultieren.
