Published Der medizinisch-technologische Fortschritt der vergangenen Jahrzehnte hat zu einer hochtechnisierten und einfach zugänglichen Schwangerenvorsorge geführt. Mit § 15 GenDG hat der Gesetzgeber die Zulässigkeit pränataldiagnostischer Kontrollen erstmals gesetzlich geregelt. Kritikpunkte an dieser Regelung gibt es jedoch viele: Die in der Praxis nur schwer umsetzbaren Aufklärungs- und Beratungserfordernisse, die Regelung zu sog. spätmanifestierenden Krankheiten (§ 15 Abs. 2 GenDG), die Einsetzung der Gendiagnostik-Kommission usw. Die Arbeit zeigt auf, dass der Gesetzgeber mit § 15 GenDG zwar einen ausreichenden Ungeborenenschutz gewährleistet, dabei jedoch ungerechtfertigt in die Grundrechte der Schwangeren eingreift. Auch die Einsetzung einer Expertenkommission zur Konkretisierung der Voraussetzungen des § 15 Abs. 1 S. 1 GenDG erweist sich als verfassungsrechtlich problematisch.
