Published Die Untersuchung befasst sich mit dem Zertifizierungsprozess der Sportverbände für Sportgeräte, die in ihrer Sportart verwendet werden. Die Zertifizierung gewährleistet die Sicherheit und Gleichheit im Sport. Die Homologation gehört zu den Kerntätigkeiten eines Verbandes, denn sie bestimmt die Regeln einer Sportart mit. Die Homologation beschränkt jedoch den Wettbewerb auf den Beschaffungsmärkten der jeweiligen Sportgeräte sowie dem Teilmarkt für Wettkampfsportgeräte. Daher untersucht diese Arbeit, unter welchen Voraussetzungen die Beschränkungen gerechtfertigt werden können (Art. 101 AEUV) und ob sie einen Missbrauch der marktbeherrschenden Stellung darstellen (Art. 102 AEUV). Die Untersuchung kommt zu dem Ergebnis, dass die Homologation notwendig ist, um den ordnungsgemäßen Ablauf des Sports zu sichern.
