Published Mit den Übergangs- und Schlussbestimmungen hat der Verfassungsgeber dem Grundgesetz einen heterogenen letzten Abschnitt zuteilwerden lassen. Seine verschiedenen Facetten fanden in sieben Jahrzehnten seiner Gültigkeit in der Jurisprudenz wenig Beachtung. Ziel dieser Untersuchung ist es, Struktur, Aufgaben und Funktionen der Übergangs- und Schlussbestimmungen des Grundgesetzes aufzuarbeiten und zu ergründen, ob sie mehr als notwendiges Beiwerk der Verfassung sind. Neben Terminologie, Typologie und geschichtlichen Aspekten der Übergangs- und Schlussbestimmungen setzt sich die Untersuchung insbesondere mit Gesichtspunkten der Kontinuität und der Erinnerung auseinander. Als Ergebnis der Untersuchung stellt sich insbesondere heraus, dass die Übergangs- und Schlussbestimmungen das Gedächtnis der Verfassung bilden.
