Summary:Creativity is a driving force behind social and economic development. Within the legal system, copyright is the area most closely tied to creativity, especially creativity related to the cultural and creative industries. However, only a copyright system that balances the interests of all parties can truly promote creativity. Therefore, it is essential to regularly examine whether the current copyright framework reflects the needs and interests of all stakeholders, particularly in the context of the internet and society’s evolving demands for creative expression. Copyright, the Internet, and the Balance of Rights explores key issues surrounding copyright in the digital age, including fair use, user rights and status, abuse and balance of rights, online infringement and piracy, and the responsibilities of internet service providers. The book examines legislative and judicial reforms in mainland China, Hong Kong, and Taiwan, and investigates how copyright can be best balanced in the internet era to maximize society’s creative potential. The book is divided into eight chapters across two parts. The first part focuses on copyright balance, abuse, and fair use; the second part centers on online infringement and the determination of legal responsibility.
