Sumari:The author develops a right of third-party notice for arbitration proceedings that can be effective without the third party being a party to the arbitration agreement or having consented to the notice. This is justified by drawing a functional comparison to the recognition of foreign judgments and third-party effects. Based on his findings, the author calls for the implementation of a right of third-party notice in the German arbitration law (secs. 1025 et seq. of the Code of Civil Procedure).
