Shrnutí:The thesis examines the extent to which court decisions have cross-jurisdictional binding effects. The focus is on res judicata (›Rechtskraft‹). As a basic condition, a uniform concept of the subject matter (›Streitgegenstand‹) is developed for the different types of jurisdiction (›Rechtswege‹) in Germany. The findings are examined in some typical cross-jurisdictional problems, namely cross-jurisdictional offsetting, adhesion proceedings and various forms of cross-jurisdictional security rights.
