Published Xuyang Qu stellt das Schuldrecht im neu erlassenen Zivilgesetzbuch der Volksrepublik China im historischen Kontext und unter Einbeziehung vorangegangener Einzelgesetze vor, arbeitet mehrere Rechtsinstitute dogmatisch auf und vergleicht systembedeutsame Aspekte mit dem deutschen Recht. Zudem übersetzt sie chinesische Regelungen, die in der Arbeit zitiert sind, ins Deutsche. Das vertragliche und das deliktische Haftungsrecht werden abgehandelt. Im Zentrum stehen der Schadensersatz wegen Pflichtverletzung, die Nacherfüllung, der Strafschadensersatz und die Geldentschädigung. Herausgearbeitet wird, dass sich die Grundsätze ›pacta sunt servanda‹ und ›casum sentit dominus‹ in beiden Rechtsordnungen anders entfalten. Dahinter stehen unterschiedliche Verständnisse über die Aufgaben des Haftungsrechts.
