Another focus of the thesis lies in the analysis of possible justifications for climate protests. Published Klimaschutz wurde bisher fast ausschließlich als Aufgabe des öffentlichen Rechts gesehen. Dabei ist die Bekämpfung des Klimawandels eine der wichtigsten Aufgaben des 21. Jahrhunderts, der sich auch die Strafrechtswissenschaft nicht entziehen darf. Die Arbeit widmet sich daher der Strafbarkeit klimaschädlicher Verhaltensweisen de lege lata und de lege ferenda. Es wird zunächst untersucht, inwieweit klimaschädliche Verhaltensweisen vom aktuellen Umweltstrafrecht erfasst sind. Auf Basis dieser Ergebnisse wird ein eigener Regelungsvorschlag zur Konzipierung eines Klimastraftatbestandes im StGB unterbreitet. Darüber hinaus beschäftigt sich die Arbeit mit den stark umstrittenen Klimaprotestaktionen.
