Shrnutí:This work analyzes the role of notarial law in the protection of fundamental rights in three key areas: family, property, and personal autonomy, within the Ecuadorian legal context. Through a doctrinal and practical approach, it explores the functions of the notary as a guarantor of legality, public faith, and legal certainty in extrajudicial acts. In family matters, notarial acts such as marriage, common-law marriage, divorce, marriage settlements, and voluntary emancipation are studied, all of which are instruments that strengthen the protection of family ties. With regard to property, the constitution of family property and its legal framework are addressed, facilitating the transfer and preservation of assets. In terms of personal autonomy, the notary allows the individual's will to be projected through powers of attorney and advance decisions, especially protecting vulnerable persons. The text also includes notarial models and frequently used documents such as contracts, powers of attorney, minutes, and deeds, promoting accessible and efficient notarial practice. The work highlights the importance of the dejudicialization of certain procedures, which contributes to a more agile and human rights-centered legal system.
