| Riassunto: | This book addresses the study of freedom of expression in the context of the digital age, analyzing its
constitutional configuration, its protection in international human rights law, and the challenges posed by its
exercise in contemporary technological environments. Starting from the recognition of freedom of expression
as a fundamental right and an essential pillar of democracy, the work examines its evolution from traditional
spaces of communication to the digital environment, understood as a new public space for deliberation,
political participation, and social control of power. The analysis focuses on the tensions that arise between
the expansion of information technologies and the need to establish legitimate constitutional limits that
guarantee the protection of other fundamental rights, such as honor, privacy, equality, and human dignity. It
also studies the role of the state and digital platforms in regulating content, emphasizing the risks of indirect
censorship, opaque private moderation, and excessive criminalization of expression. From a constitutional
and inter-American perspective, the book proposes a guarantee-based interpretation of freedom of
expression in the digital environment, based on the principles of legality, necessity, proportionality, and
prohibition of prior censorship. Finally, it reflects on the current and future challenges facing constitutionalism
in the face of technological power, highlighting the importance of preserving a pluralistic, open digital space
that respects human rights in democratic societies. |
