This book sets out to do just that. Published Ziviler Ungehorsam ist wieder aktuell und wird insbesondere in der politischen Theorie breit diskutiert. In der juristischen Literatur ist das Thema allerdings bislang unterbelichtet. Nicht zuletzt fehlt bis dato eine differenzierte verfassungsrechtliche Analyse, die zwischen den verschiedenen Formen zivilen Ungehorsams unterscheidet und separat nach der Rolle von Demokratie und Ordnung als den Hauptdeterminanten der rechtlichen Debatte fragt. Eine solche Analyse zeigt, dass Demokratie und Ordnung insbesondere dann keine durchdringenden Einwände gegen einen rechtlichen Schutz zivilen Ungehorsams darstellen, wenn es (nur) um einen »richtigen« Ungehorsam geht, der sich gegen tatsächliches Unrecht richtet. Die Freiheit demokratischer Entscheidung endet im Rechtsstaat an den Grenzen des Rechts.
