Published Die Verführung und das manipulative Überreden sind seit jeher Themen, die faszinieren. Zeugen dieser Faszination sind die zahlreichen Schriften, literarischen Werke und Filme, die von einem Verführer handeln, der durch seine Rhetorik und seinen habilen Gebrauch von Worten andere Akteure dazu bringt, (rechtswidrige) Handlungen zu vollziehen. Die rechtsvergleichende Arbeit beschäftigt sich mit derjenigen Gruppe von Straftatbeständen im deutschen und französischen Recht, in denen Informationsübermittlungen unter Strafe gestellt werden, denen die Gefahr zugesprochen wird, straftatenfördernd zu wirken: die sog. Motivationsdelikte. Ein Ziel der Bestrafung von Motivationsdelikten ist es also präventiv zu agieren. Die Arbeit untersucht damit nicht nur eine bestimmte Gruppe von Tatbeständen, sondern analysiert auch die vermehrte Vorverlagerung der Strafbarkeit im Allgemeinen und deren strafrechtsdogmatischen Herausforderungen im deutschen und französischen Recht. In diesem Zusammenhang stellt die Verfasserin die Frage der Zurechenbarkeit als eine zentrale Problematik heraus; d.h., ob und ab wann mögliche Rechtsgutsbeeinträchtigungen durch einen eigenverantwortlich agierenden Zweithandelnden dem Verantwortungsbereich des Motivators zugerechnet werden könnten.
