With the Media Services Investment Obligation Act (MedienInvestVG), the federal government aims to introduce a mandatory investment requirement for audiovisual media service providers. However, this proposal raises significant questions: How far does the federal government’s legislative authority extend? Are mandatory investment requirements, sub-quotas, and the allocation of rights appropriate and proportionate for achieving cultural and regional policy objectives? In particular, does the planned revocation of rights exceed the limits set by the Constitution and EU law? The study shows that, in their specific form, the proposed instruments do not comply with constitutional and EU law—and that milder, equally effective alternatives are available. |
