Shrnutí:The work demonstrates the potential value of abuse-independent t divestiture powers for competition enforcement: they enable structural remedies even where prohibitions do not apply or infringements are difficult to prove. Using a comparative law approach, the study examines the existing regimes in Germany and the United Kingdom in their historical and systematic context and assesses them on the basis of practical cases of application. Based on this comparison, a country report analyses the legal situation in Switzerland and discusses the permissibility and expediency of introducing such a power. The dissertation concludes with a fully drafted legislative proposal for the Swiss Cartel Act.
