| সংক্ষিপ্ত: | This volume brings together a collection of papers arising from an international symposium held in 2024, all centred on a common objective: to examine, from an interdisciplinary and long-term perspective, the relationship between law and violence. Far from conceiving violence as a phenomenon external to or antithetical to the legal order, this work regards it as a constitutive element of that order, embedded both in its founding moments and in the practices that ensure its day-to-day functioning. In this light, the law is analysed as a discursive and practical mechanism that not only organises and channels, but also produces and legitimises various forms of violence — not only physical, but also symbolic, economic and cultural. The volume is situated within the context of the Western world, understood not as a given entity but as a historical and conceptual construct, and explores the ways in which, from the Middle Ages to the present day, legal mechanisms have been shaped to transform overt violence into regulated, managed and socially accepted forms. Within this framework, attention is also paid to the contemporary crisis in international law and the tensions affecting the global legal order. Structured in four parts, the book combines theoretical approaches and case studies with the aim of offering a range of diverse interpretations of the interplay between law, violence and justice. In this exploration, judicial practice emerges as a prime vantage point from which to analyse the specific ways in which these dynamics unfold and are reshaped. |
