Die klinische Prüfung von Arzneimitteln steht im Spannungsfeld zwischen dem wichtigen wissenschaftlichen Fortschritt zugunsten künftiger Patienten auf der einen und dem notwendigen Schutz der Probanden auf der anderen Seite. Dieses Spannungsverhältnis spitzt sich zu, wenn vulnerable Personen – wie schwangere Frauen – in die klinische Erprobung von Arzneimitteln einbezogen werden. Während das AMG für Minderjährige oder andere einwilligungsunfähige Personen besondere Regelungen zur Teilnahme an klinischen Prüfungen vorsieht, fehlen gesetzliche Vorgaben zur Einbeziehung von Schwangeren. Ausgehend von dieser unsicheren Rechtslage werden Lösungsansätze entwickelt, die einen Ausweg aus dem Dilemma weisen.
