In this study, the different representation schemes on health matters are presented. Eine ärztliche Maßnahme tastet die leibliche und gegebenenfalls die seelische Integrität eines Menschen an. Die Bestimmung darüber ist ein Teil der Personalität eines Menschen. Der Einzelne kann sein Selbstbestimmungsrecht nur wahrnehmen, wenn seine Entscheidung Voraussetzung gerechtfertigten ärztlichen Handelns ist. Kann ein Volljähriger auf Grund einer Krankheit oder Behinderung darüber nicht befinden, können Entscheidungen durch einen rechtsgeschäftlichen Vertreter – einen Bevollmächtigten – oder durch einen gesetzlichen Vertreter – einen Betreuer – getroffen werden. In der vorliegenden Untersuchung werden die unterschiedlichen Vertretungsregelungen im Bereich der Gesundheitsangelegenheiten dargestellt. Es wird zudem geprüft, ob es das Selbstbestimmungsrecht des Einzelnen gebietet, eine weitere „automatische“ Vertretungsmöglichkeit für nahe Angehörige zu normieren.
