The phenomenon of abuse of official authority is widespread in all societies. In contrast to Germany, the Italian legislature has made abuse of office a punishable offense in Article 323 of the Code of Criminal Procedure. The offense has recently gained notoriety in Germany as a result of the indictment of high-ranking politicians in Italy. The provision has a turbulent history and has been the subject of intense scholarly debate in Italy. The present paper addresses this issue by explaining the elements of the crime.
