Zur Frage, ob sich richterliche Aktivität im Sinne einer Materialisierung auswirkt, betrachtet er rechtsvergleichend das englische Recht. Zur Bewertung einer möglichen Materialisierung wird grundlegend darauf rekurriert, warum im modernen Rechtsstaat überhaupt ein Zivilprozess existiert und wie dieser idealerweise ausgestaltet sein sollte. |
