Published Die Studie erschließt die Kodifikationstheorie Georg Wilhelm Friedrich Hegels für aktuelle rechtstheoretische Diskussionen. Sie zeigt, dass Hegels Äußerungen zum – bis heute maßgeblich mit den Protagonisten Friedrich Carl von Savigny und Anton Friedrich Justus Thibaut assoziierten – Streit um die Möglichkeiten einer systematisierenden Verschriftlichung des bürgerlichen Rechts nicht lediglich als zeitbezogene Invektive zu verstehen sind. Sie sind vielmehr eng mit Hegels rechtsphilosophischem Programm verknüpft: Die Abfassung eines formell und materiell allgemeinen Gesetzbuchs ist nach Hegels Auffassung Grundlage von Freiheit, juristische Systembildung ist Aufgabe der Philosophie, seine Grundlinien der Philosophie des Rechts sind Beispiel für das denkende Erfassen des Rechtsstoffs, das einer Kodifikation zugrunde liegen muss. Die philosophische Zeitlosigkeit der Anforderungen, die Hegel an ein Kodifikationsprojekt stellt, lässt schließlich Aussagen über aktuelle Systembildungsversuche auf der Ebene der Europäischen Union zu.
