In Eugen Paschukanis Begriff der Rechtsform kulminiert die Dialektik von Freiheit und Herrschaft der bürgerlichen Gesellschaft. Dabei wird das Recht nicht als Instrument verstanden, sondern unabhängig von seiner konkreten inhaltlichen Ausgestaltung als Form reflektiert.
