Published Es ist seit langer Zeit anerkannt, dass Gesetze richtlinienkonform auszulegen und fortzubilden sind. Ob auch Tarifverträge richtlinienkonform ausgelegt und fortgebildet werden müssen, ist jedoch ungeklärt. Die Tarifnormen wirken zwar ähnlich wie Gesetze. Zugleich sind Tarifverträge aber privatrechtliche Verträge. Die Arbeit beantwortet die Forschungsfragen differenziert. Die Gerichte für Arbeitssachen sind weder aufgrund des nationalen Rechts noch des Unionsrechts verpflichtet, Tarifverträge privater Tarifvertragsparteien richtlinienkonform auszulegen und fortzubilden. Demgegenüber sind Tarifverträge staatlicher Tarifvertragsparteien zugunsten der Arbeitnehmerseite richtlinienkonform auszulegen und fortzubilden. Abschließend beleuchtet die Arbeit den Richtlinieneinfluss in Konstellationen, in denen die Exekutive die Geltung tarifvertraglicher Regelungen erstreckt – also den Einfluss auf allgemeinverbindliche Tarifverträge sowie Rechtsverordnungen, die auf Grundlage von §§ 7, 7a AEntG erlassen werden.
