Summary:Worldwide, the demand for digital services is concentrated on a few, extremely powerful companies. An international competition policy debate has been initiated as to the extent to which ex-post abuse control under competition law needs to be supplemented by ex-ante regulatory measures. Various studies have been published that deal with the design of possible regulatory measures and the prediction of the regulatory consequences to be expected. Findings from comparable sectors that have been the subject of comparable regulation for decades were ignored. The necessity of sector-specific ex-ante regulation in the digital economy is analyzed based on findings from the regulation of the telecommunications sector in Germany and Switzerland (2004-2020).
