Findings from comparable sectors that have been the subject of comparable regulation for decades were ignored. The necessity of sector-specific ex-ante regulation in the digital economy is analyzed based on findings from the regulation of the telecommunications sector in Germany and Switzerland (2004-2020). Weltweit konzentriert sich die Nachfrage nach digitalen Diensten auf wenige, überaus marktmächtige Unternehmen. International wurde eine wettbewerbspolitische Debatte darüber angestoßen, inwieweit die wettbewerbsrechtliche ex-post Missbrauchskontrolle einer Ergänzung durch regulatorische ex-ante Maßnahmen bedarf. Verschiedene Studien wurden veröffentlicht, die sich der Ausgestaltung möglicher regulatorischer Maßnahmen und der Prognose von zu erwartenden Regulierungsfolgen widmen. Unbeachtet blieben Erkenntnisse aus vergleichbaren Sektoren, die bereits seit Jahrzehnten den Gegenstand vergleichbarer Regulierung bilden.
