Shrnutí:In German constitutional law ›Verfassungswandel‹ means a change in the meaning of constitutional provisions without explicit amendments to the text of the constitution. It is to be distinguished from a mere change of interpretation in specific cases. The thesis applies this idea to any kind of law (›Rechtswandel‹). This perspective opens up new insights into fundamental questions of legal and democratic theory. Against this backdrop, the thesis criticizes the prevailing legal practice.
