This perspective opens up new insights into fundamental questions of legal and democratic theory. Against this backdrop, the thesis criticizes the prevailing legal practice. Published Die Arbeit löst die schillernde Figur des Verfassungswandels aus ihrer verfassungsspezifischen Engführung, mit welcher sich in einer konstitutionalisierten Rechtsordnung die aufgeworfenen Probleme nicht adäquat erfassen lassen, und entwickelt vor diesem Hintergrund die übergreifende Kategorie des Rechtswandels. Das in Abgrenzung zu anderen Kategorien der informellen Rechtsentwicklung spezifische Moment des Wandels ist die sich im praktischen Ergebnis auswirkende generelle Veränderung der einer Norm zugrundeliegenden bzw. zugeschriebenen Wertung. Damit eröffnet der Rechtswandel neue Perspektiven auf grundlegende rechts- und demokratietheoretische Fragen und macht Verbindungslinien zwischen der herrschenden Rechtspraxis und unserer verrechtlichten Debattenkultur deutlich.
