Sumari:Despite legal commitments, the German government's climate policy is not sufficient to achieve the 1.5-degree-target. Climate activism offences are intended to draw attention to this problem, demand government action and aim to protect fundamental rights. They thus differ from ›ordinary‹ crime. Section 34 of the German Criminal Code cannot fully reflect this. Thus, legislative regulation is needed that takes into account the democratic potential of climate activism protests.
