Klimaaktivistische Straftaten, welche auf diesen Missstand aufmerksam machen, ein Handeln des Staates fordern sowie den Schutz der Grundrechte der Gesamtbevölkerung bezwecken, unterscheiden sich von »klassischer« Kriminalität. Dies bedarf einer strafrechtlichen Berücksichtigung. Klimaaktivistisches Verhalten kann dabei zwar ausnahmsweise durch den Notstand des § 34 StGB gerechtfertigt sein. Da die Rechtfertigungsgründe aber nicht zur Bewältigung gesellschaftlicher Phänomene ausgelegt sind, sondern nur strafbares Verhalten im Einzelfall erfassen, vermögen sie der Bewegung nicht beizukommen. In der Rechtsprechung werden daher sogar vergleichbare Aspekte der Protestaktionen uneinheitlich behandelt.
