Missbräuchliche Datenoffenlegungen gefährden sowohl den Betroffenenschutz als auch die gesellschaftliche Akzeptanz der Forschung. Als »Goldstandard« zur Auflösung dieses Spannungsverhältnisses zwischen Forschungsfreiheit und Datenschutz gilt die Einwilligung der Betroffenen. In der Praxis offenbart diese jedoch insbesondere bei der Sekundärnutzung von Daten erhebliche Defizite. Die Arbeit entwickelt daher bestehende Forschungsklauseln um flankierende Schutzmechanismen de lege ferenda fort.
