Published Internal Investigations sind mittlerweile als repressive Compliance-Maßnahme fest im Wirtschaftsleben integriert. Der Umgang mit den zentralen Mitarbeiterauskünften, insbesondere deren Verwertbarkeit im Strafprozess, bleibt jedoch weiterhin hoch umstritten. Der Autor befasst sich mit Konflikten zwischen arbeitsrechtlichen Auskunftsansprüchen und strafprozessualer Selbstbelastungsfreiheit. Dazu widmet er sich zunächst dem rechtlichen Fundament der Selbstbelastungsfreiheit und deren Reichweite sowie den Motiven, Möglichkeiten und Grenzen von Internal Investigations. Die daraus gewonnenen Erkenntnisse bilden wiederum die Grundlage für die umfassende Ausarbeitung einer Lösung für das Spannungsverhältnis zwischen erzwungenen Mitarbeiterauskünften einerseits und der Selbstbelastungsfreiheit andererseits. Anhand des gefundenen Lösungsansatzes setzt sich der Autor zudem kritisch mit dem Regierungsentwurf eines VerSanG aus dem Jahr 2020 auseinander, der erstmals Internal Investigations gesetzlich regeln sollte.
