Shrnutí:The thesis examines the strict official burden of proof that has been developed in recent case law on assembly law for the justification of a police state of emergency. Following a presentation of the principles of administrative assistance law and the significance of duties to protect under assembly law, the work develops a solution for the as yet unresolved attribution of insufficiently justified refusals of administrative assistance in transnational constellations.
