Published Die Arbeit überprüft die strengen behördlichen Darlegungslasten, die in der jüngeren Rechtsprechung zum Versammlungsrecht für die Begründung des polizeilichen Notstandes entwickelt worden sind. Es gilt: Um friedliche Versammlungen auch bei Gegenprotesten oder anderen Gefahrenlagen zu ermöglichen, müssen Versammlungsbehörden mittels Amtshilfe alle verfügbaren Polizeikräfte von Bund und Ländern zusammenziehen. Nur wenn ein Schutz trotzdem nicht gewährleistet werden kann, dürfen die Versammlungen unter Berufung auf den polizeilichen Notstand eingeschränkt werden. Nach einer Darstellung der Grundlagen samt Bedeutung der Amtshilfe behandelt die Arbeit Probleme, die auftreten, wenn Amtshilfe verweigert und die Entscheidung unzureichend begründet wird. Vor allem länderübergreifend ist ungeklärt, ob die unzureichend begründete Amtshilfeverweigerung den Versammlungsbehörden zuzurechnen ist.
