Im nationalen Verwaltungsrechtsschutzsystem, das geprägt ist vom Individualrechtsschutz, haben anerkannte Umweltvereinigungen, denen altruistische Klagerechte zustehen, aber weiterhin eine Sonderstellung. Die stetig wachsende Liste anerkannter Umweltvereinigungen und das Urteil des EuGH vom 15.10.2015 (C 137/14), welches die Möglichkeit einer »Missbrauchsregelung« zur Gewährleistung der Wirksamkeit des gerichtlichen Verfahrens eröffnete, haben eine Debatte um die Befugnisse und Legitimität der Umweltvereinigungen entfacht. Die Arbeit betrachtet das Verwaltungsrechtschutzsystem in Deutschland und die Vorgaben, die bei der Ausgestaltung der Umweltverbandsklage beachtet werden müssen.
